OpenAI was founded by Altman and other tech entrepreneurs in 2015, including Elon Musk, CEO of Tesla. Musk left the company in 2018, unhappy with the company's leadership and achievements.

In March 2024, Musk filed a lawsuit against OpenAI arguing that by creating a for-profit structure, it violated its founding mission as a non-profit company. OpenAI retracted the complaint, which was withdrawn and refiled over the summer, and in a new blog post and legal filing outlined Musk's past agreement with a for-profit structure.
