A federal judge ordered the Trump administration to return a man to Maryland, who was wrongly deported to a prison in El Salvador.
Kilmar Abergo Garcia, who was expelled last month, along with hundreds of alleged band members, must be returned to the United States from no later than Monday, the US District Judge Paula Sinis ordered.
US Immigration and Customs Implementation (ICE) said in a recent court case that deportation of G -N Garcia is an “administrative mistake”. An immigration judge provided him with legal protection against deportation in 2019.
The White House claims that Mr Garcia is a member of the MS-13 gang, but his lawyers claim that there is no evidence to prove that he is related to the gang.
G -n Garcia's lawyers also claim that he has never been charged with a crime in any country.
By issuing his order on Monday, Judge Sinin called the deportation of G -n Garcia “illegal act”.
“The Congress said you couldn't do it and you did it anyway,” she told lawyers of the Ministry of Justice.
US lawyers say the government is powerless to cancel deportation because G -n Garcia is already in the arrest of Salvadoran.
G -n Garcia's lawyers said the claims of the Trump administration were “outrageous”.
“They come to this court and say,” We have not tried anything and we are all out of options, “lawyer Simon Sandoval-Moshenberg told Judge Sinin.
The family of G -H Garcia, including his wife, Jennifer Vasquez Surah, a US citizen, are calling for his release after his deportation in mid -March. Surah Surah told reporters that she did not talk to her husband as he was taken by the US authorities.
The case outraged many who have expressed concerns about the latest deportations committed by the Trump administration of non -citizens who are legal in the United States.
