The case of Kilmar Abrego Garcia – 29 -year -old by El Salvador, who was deported from the United States in March – caused a legal expense for the administration's immigration policy.
The judges all the way to the US Supreme Court have ruled that G -N Abrego Garcia has been deported by mistake and that the US government should help “facilitate” his return to his home in Maryland.
But the White House has accused Mr Abrego Garcia of being a member of the Transnational Salvadorian gang MS-13, a certain foreign terrorist organization, saying that he will never live in the United States again.
Abrego Garcia denies that he is a member of the gang and has not been convicted of a crime.
The BBC Verify examined the court documents and public records to determine what is known-and what is not yet known-for Mr. Abrego Garcia and his alleged links to MS-13.
What do we know about the alleged MS-13 links?
G -n Abrego Garcia admitted that it illegally enters the United States in 2012, According to court documents.
In March 2019, he was detained with three other people in Haatsville, Maryland, in the parking lot of a home depot.
Officers in the Police Department of Prince George County said the men were “Lotting” and subsequently identified Mr. Abrego Garcia and two of the rest as members of MS-13.
In a document entitled “The Band Interview”, the local police described their observations in detail.
They said that G -n Abrego Garcia wears “Chicago Bulls hat and a hood with rolls of money covering the eyes, ears and mouths of the presidents of individual denominations.”
Officers claim that clothing is “indicative of the culture of the Spanish gang” and that “wearing the Chicago Bulls hat is Thay (SIC), they are a member in good condition with MS-13”.
Stephen Dudley, a journalist and author who spent years in studying the MS-13 band, said it was true that “at one point, the Chicago Bulls logo with the horns has become a variety for the Devil Horns MS-13 symbol.”
But wearing the logo of the extremely popular basketball team, he added, of course, is not exclusive to the band.
“Any allegation of the band's affiliation must be confirmed by testimony, criminal history and other confirming evidence,” said G -n Dudley.
According to the field interview list and other court documents, employees said they had also been advised by a “proven and reliable source” that Mr. Abrego Garcia was an active member of the “Western Click” of MS-13, with the rank of Chequeo.
However, Dudley says Chequeo is not a rank, but instead used to indicate recruits who are yet to be initiated.

G -n ABREGO GARCIA Lawyers argued in court documents that the “click of the Western” is based in New York, where their client has never lived. According to government documents, he rejected the information provided to the police against him as a “handset”.
According to his lawyersAbrego Garcia has never been convicted of a crime, including gang membership, in the US or in El Salvador. He lived in the United States for 14 years, had three children and worked in construction, according to court records.
But the judge who chaired his case for 2019. said that on the basis of confidential informationThere was sufficient evidence to support the gang membership of G -N Abrego Garcia. This finding was later supported by another judgeS
As a result, the abrego Garcia was denied on bail and remained in custody. During this time, he applied for asylum to prevent his deportation to Salvador.
In October 2019, he received an order for “detention of removal”, Court documents show – Status other than asylum, but what prevented the US government from sending him back to Salvador because he may encounter harm.
G -n ABREGO GARCIA's lawyers say it has been provided with status Based on his “well -justified” fear of pursuing from Barrio-18, the main competitive band of MS-13.
He said that before entering the United States, his family and their business were threatened and blackmailed by Barrio-18.
Since 2019, when he was released by the defense order, Mr Abgo Garcia's attorneys say he had annual inspections with immigration officials who were present “without failure and without incidents.”
What are the individual allegations against him?
G -n Abrego Garcia has encountered at least two other allegations of criminal activity, none of which led to a sentence.
In 2021, his wife Jennifer Vasquez Surah applied for a defensive order against him, claiming that he had physically attacked her several times, According to documents shared by the US Department of Interior SecurityS
D -Ja Vasquez Surah said in a statement on April 16 that she decided not to follow the trial at that time and that she and her husband “managed to work through this situation as a family, including by going to consultation.”
She described her husband as a “loving partner and father” and repeatedly denied he was a member of the MS-13 gang.
On April 15, White House press secretary Carolyn Levit also accused the abrego Garcia of participating in human trafficking.
She seems to refer to a Tennessee Star report, a conservative news website saying that D -N -Abango Garcia was detained by a Tennessee employee in suspicion of human trafficking in December 2022 while driving a vehicle carrying seven passengers.
The report quoted unnamed sources said the employees had contacted the FBI and later released it and passengers.
In a statement, the Tennessee highway patrol confirmed that the abrego Garcia was stopped because of a speed of 2022, but was released after the officers contacted the FBI.
The agency did not comment on the other details included in the Tennessee Star report that the BBC has not confirmed.
The FBI declined to comment. The BBC contacted the lawyers of G -N Abrego Garcia.
