President-elect Donald Trump asked a question Supreme Court delay legislation that could ban TikTok until after his inauguration. In an amicus brief, Trump lawyer D. John Sauer wrote that the incoming president wants the opportunity to find a solution to the problem through “political means.”
Law requiring TikTok to be banned or sold will go into effect January 19, 2025just one day before Trump's inauguration. The brief calls the ban date “unfortunately timely” and argues that the new president should have more time to work on the TikTok agreement. TikTok's legal team raised similar concerns in its requests to delay the ban. The review also cited Trump's expertise in “deal-making” and his social media platform Truth Social.
“Only President Trump has unparalleled negotiating experience, the electoral mandate, and the political will to negotiate a resolution designed to salvage the platform while addressing the national security concerns expressed by the government—concerns that President Trump himself has acknowledged,” Sauer wrote.
Trump's position on TikTok is very different from the one he took in his first term, when he sought a ban on the app in 2020. He also floated the idea that Microsoft could “make a deal, a proper deal, so that the United States Treasury gets a lot of money,” without explaining exactly how such a deal would work.
President Trump changed his mind about banning TikTok during his second campaign. He said CNBC Scream box in March, banning TikTok “would make Facebook bigger, and I think Facebook is the enemy of the people, like a lot of media outlets.”
The Supreme Court will hear arguments on the ban on January 10.
